Terms and Conditions of Sale cycle
Article 1 – Purpose
These general terms and conditions of sale define the rights and obligations of SASU NETIFUL and the Client concerning the products presented by SASU NETIFUL on its website www.seaurond.com (hereinafter referred to as “the Site”). They apply exclusively between SASU NETIFUL, located at 898 route de Cassiada, 40990 TETHIEU, Siret: 84165861000032, and any individual consumer visiting or purchasing through the said Site (hereinafter referred to as “the Client”). Any order of products offered on the SEAUROND online store implies unconditional acceptance by the Client of these general terms and conditions of sale. Products are offered for sale in the following geographic territory: Mainland France. SASU NETIFUL reserves the right to modify these general terms and conditions of sale at any time.
Article 2 – Acceptance of the General Terms and Conditions of Sale (T&Cs)
The Client acknowledges having read, at the time of validating their order, the specific terms of sale outlined on the Site, as well as the terms detailed herein, which together constitute the general terms and conditions of online sale. Consequently, the act of placing an order by the Client constitutes full and unconditional acceptance of these T&Cs, which alone apply to the resulting contract.
Article 3 – Products on seaurond.com
In accordance with Article L. 111-1 of the French Consumer Code, the Buyer can, before placing their order, review the main characteristics of the products they wish to purchase on the website www.seaurond.com. Products are available at the prices and under the conditions displayed as long as they are visible on the website www.seaurond.com and subject to stock availability. In case of unavailability of a product in an order, an email notifying the Client of the stock shortage will be sent. SASU NETIFUL reserves the right to offer an equivalent product or cancel the unavailable item from the order and proceed with its refund. Photographs and descriptions of the products offered for sale are indicative only and do not constitute a commitment from the seller.
Article 4 – Prices
Prices displayed on the website www.seaurond.com, in Euros, are those in effect at the time of the Client’s order. Delivery fees are borne by the Client, except in specific cases where they are covered by www.seaurond.com. Details regarding delivery fees, including locations, terms, and amounts, are provided before the order validation. The total price indicated in the order summary is the final price, which includes the total cost of the order, detailing each product and any applicable delivery fees. All prices are indicated inclusive of all taxes (TTC), including VAT. SASU NETIFUL reserves the right to modify the selling prices of products at any time. Such modifications will be communicated to the Buyer before placing an order.
Article 5 – Processing Your Order
An order is recorded on the SEAUROND online store and validated by the Client when they click on the payment option on the “Payment” page. Orders are only final once the payment has been confirmed by the Buyer, and a confirmation email has been sent to the Client.
Article 6 – Payment Terms
Payment must be made when the order is validated by the Client. All orders are payable in Euros. SASU NETIFUL reserves the right to suspend or cancel any order and/or delivery, regardless of its execution stage, in case of non-payment or payment incident by the Client. Accepted payment methods include National Debit Card, Visa, and Mastercard. The website www.seaurond.com is equipped with the PAYPLUG secure payment solution. SEAUROND also accepts payment via PayPal, which allows the transfer of electronic money securely online. The sale is considered final only after payment validation by PAYPLUG or PayPal.
Article 7 – Delivery Terms
Products will be delivered to the address provided by the Client on the order form within Mainland France. Invoices are sent to the email address specified by the Client when creating their account. Orders are processed Monday through Friday, excluding public holidays. Delivery times are indicative and cannot lead to order cancellation or damages claims in case of delays caused by unforeseen events. The risk during transport is borne entirely by the recipient. In case of missing or damaged goods, the Buyer must make necessary reservations on the delivery note at the time of receipt and report them in writing within five days by registered mail with acknowledgment of receipt.
Article 8 – Right of Withdrawal
In accordance with Article L. 121-20 of the French Consumer Code, the Client has a 14-day period from the receipt date to return, at their expense, the ordered products for a refund. Requests for withdrawal must be made via email to contact@netiful.com.
Article 9 – Transfer of Product Ownership
SASU NETIFUL retains full ownership of the products sold until full payment is received, including all associated taxes and fees.
Article 10 – Intellectual Property
All elements on www.seaurond.com, including visuals and sound, are protected by copyright, trademarks, and patents.
Article 11 – Liability
The Seller’s liability cannot be engaged in case of non-fulfillment or delays due to force majeure as defined by Article 1148 of the French Civil Code.
Article 12 – Data Protection
Under the French Data Protection Act of January 6, 1978, Clients have the right to access, modify, or delete their data by contacting contact@netiful.com.
Article 13 – Partial Nullity
If one or more provisions of these T&Cs are deemed invalid, the other provisions will remain fully enforceable.
Article 14 – No Waiver
Failure by either party to enforce any provision of these T&Cs will not constitute a waiver of the right to enforce it later.
